1. Introduction

These Terms and Conditions ("Terms") govern your use of the services provided by Sanctuary 44 Pty Ltd (ACN 691 088 687) ("we", "us", "our") operating as Sanctuary 44, including our website at www.sanctuary44.com.au, online bookings, in-person sound bath and group healing sessions, 1:1 online coaching sessions, and digital products and downloads ("Services").

By booking, purchasing, or participating in any of our Services, you agree to be bound by these Terms. Please read them carefully before proceeding.

2. About Our Services

Sanctuary 44 offers holistic wellness services including:

  • In-person sound bath and group healing sessions
  • 1:1 online coaching sessions
  • Digital products and downloadable content

Our services are provided for general wellness and personal development purposes only. They are not a substitute for medical, psychological, or psychiatric treatment. We do not diagnose, treat, or cure any medical condition.

3. Bookings & Payments

All bookings are made through our online booking system via our website. By completing a booking, you confirm that you have read and accept these Terms.

Full payment is required at the time of booking. All prices are displayed on our website and are in Australian dollars (AUD) inclusive of GST where applicable.

Sanctuary 44 reserves the right to refuse or cancel a booking at our discretion, including where a session may not be appropriate for a client's circumstances.

4. Cancellations & Refunds

We understand that circumstances can change. Our cancellation and refund policy is as follows:

Group Sound Bath Sessions

  • Cancellations made more than 24 hours before your scheduled session are eligible for a full refund or a credit toward a future session — your choice.
  • Cancellations made within 24 hours of your scheduled session are not eligible for a refund. A credit may be offered at our discretion; please reach out to us directly.
  • No-shows (failure to attend without prior notice) are not eligible for a refund or credit.

1:1 Online Coaching Sessions

  • Cancellations made more than 24 hours before your scheduled session are eligible for a full refund.
  • Cancellations made within 24 hours of your scheduled session are not eligible for a refund.
  • No-shows (failure to attend without prior notice) are not eligible for a refund.

Digital Products

  • Digital products and downloads are non-refundable once accessed or downloaded.

If Sanctuary 44 needs to cancel or reschedule your session, we will provide a full refund or offer an alternative session time. We will give you as much notice as possible in these circumstances.

5. Health & Safety

Prior to participating in any in-person or 1:1 session, clients are required to complete a separate Health Intake and Consent Form. This form is provided at the time of booking and must be completed before your first session. It is your responsibility to disclose any relevant health conditions, injuries, pregnancies, or concerns that may affect your ability to participate safely.

The Health Intake and Consent Form forms part of your agreement with Sanctuary 44. By attending a session, you confirm that:

  • The information you have provided in the intake form is accurate and complete to the best of your knowledge.
  • You have consulted with a qualified medical professional if you have any health concerns relevant to participating in sound healing or coaching sessions.
  • You accept responsibility for your own wellbeing and participation.

Sanctuary 44 reserves the right to decline to provide services to any person whose health circumstances, in our reasonable opinion, make participation unsuitable or unsafe.

6. Intellectual Property

All content on our website and in our digital products, including text, audio, images, graphics, course materials, and downloadable resources, is the intellectual property of Sanctuary 44 and is protected by Australian copyright law.

You may not reproduce, distribute, modify, or commercially exploit any of our content without our prior written consent. Digital products purchased are licensed for your personal use only and may not be shared, resold, or redistributed.

7. Online Coaching Sessions

For 1:1 online coaching sessions, you are responsible for ensuring you have a suitable device, stable internet connection, and a private, comfortable space in which to participate. Sanctuary 44 is not responsible for technical issues on your end that affect your session.

Online coaching sessions are not to be recorded by participants without our prior written consent.

8. Photography & Filming

To protect the privacy, comfort, and safety of all participants, the following applies at all in-person sessions:

  • Photography, video recording, and audio recording by participants are not permitted during sessions without the prior written consent of Sanctuary 44 and all other participants present.
  • Sanctuary 44 may occasionally photograph or film sessions for promotional or educational purposes. If we intend to do so, we will notify participants in advance and obtain written consent before any identifiable images or recordings are used publicly.
  • You may request to opt out of any photography or filming by Sanctuary 44 at any time, and we will honour that request without question.
  • Any images or recordings taken in breach of this policy must be deleted immediately upon request.

By attending an in-person session, you agree to respect the privacy of other participants and comply with this policy.

9. Limitation of Liability

To the maximum extent permitted by law, Sanctuary 44 and its personnel will not be liable for any loss, injury, damage, or claim arising from your participation in our Services, including but not limited to indirect, consequential, or incidental loss. Our liability is limited to the amount you paid for the relevant session or product.

Nothing in these Terms excludes any consumer guarantee or right that cannot be excluded under the Australian Consumer Law.

10. Governing Law

These Terms are governed by the laws of South Australia, Australia. Any disputes arising from these Terms will be subject to the exclusive jurisdiction of the courts of South Australia.

11. Changes to These Terms

We may update these Terms from time to time. Updated Terms will be posted on our website with a revised date. Your continued use of our Services after any changes constitutes your acceptance of the updated Terms.

Our Services are complementary in nature and are not intended to replace conventional medical, psychological, psychiatric, or other professional healthcare treatment. We do not diagnose, treat, cure, or prevent any disease, illness, or medical condition.

2. Medical Disclaimer

You should always consult a qualified medical professional before commencing any complementary therapy, particularly if you:

  • Are pregnant or breastfeeding
  • Have a heart condition, pacemaker, or other implanted device
  • Have a history of epilepsy, seizures, or neurological conditions
  • Have been diagnosed with a serious mental health condition
  • Are currently undergoing medical treatment or taking prescription medication
  • Have a cochlear implant or hearing aid

Any testimonials or examples shared are individual experiences and are not intended to represent or guarantee that anyone will achieve the same or similar results.

4. Assumption of Risk

By booking and participating in our Services, you voluntarily acknowledge and accept that:

  • Holistic and sound healing practices involve a degree of personal risk
  • You are participating of your own free will and have disclosed all relevant health information
  • Sanctuary 44 has provided information about the nature of the session and given you the opportunity to ask questions
  • You take full personal responsibility for your participation and any effects experienced
